General Terms & Conditions
By signing up for our Services, you confirm that you are at least 18 years old and legally capable of entering into a binding contract, or that you are acting with the explicit permission and using the payment details of a person or organization who agrees to be bound by these Terms and Conditions. You acknowledge that your use of the Services must comply with our Acceptable Use Policy and Fair Use Policy.
- Definitions
- "Agreement" means the present contract incorporating these General Terms & Conditions.
- "Provider" means EuroHost.com, operated by IK Netsol, registered in Latvia, EU.
- "Client" or "You" means the natural or legal person purchasing services from the Provider.
- "Services" means hosting, domain registration, and related digital services provided electronically.
- "Digital Content" means data produced and supplied in digital form, as defined in Directive (EU) 2019/770.
- Contract Formation and Term
- By placing an order, You confirm that You are at least 18 years old and legally capable of entering into binding contracts under EU law.
- The contract enters into force upon Provider’s written confirmation of the order.
- Services are supplied on a recurring basis until canceled in accordance with these Terms.
- Right of Withdrawal
- Consumers within the EU have the right to withdraw from this contract within 14 days after conclusion, in accordance with Directive 2011/83/EU.
- The right of withdrawal does not apply to digital services once performance has begun with the consumer’s express consent and acknowledgment of loss of withdrawal rights.
- To exercise the right of withdrawal, You must send a clear statement to [email protected] before the expiry of the withdrawal period.
- Provision of Digital Services
- Services are delivered electronically and deemed provided when activated or configured on Provider’s systems.
- Domain registration or transfer is completed when reflected in the WHOIS database.
- Written confirmation of delivery is sent by email to the Client.
- Payments and Invoicing
- All services must be paid in advance according to the selected billing cycle.
- Prices include VAT where applicable in accordance with Council Directive 2006/112/EC.
- Invoices are issued electronically; no paper invoices will be sent.
- Failure to pay on time may result in suspension or termination of services.
- Refunds
- Refunds may be issued for prepaid but unused periods if services are canceled according to procedure.
- Domain registrations are non-refundable due to their irreversible nature.
- Refund requests are processed within 14 business days.
- Data Protection
- The Provider processes personal data in compliance with Regulation (EU) 2016/679 (GDPR).
- Clients have the right to access, rectify, and erase their personal data, and to object to processing.
- Personal data is used solely for contract performance, billing, and compliance purposes.
- Acceptable Use
- You agree not to use Services for unlawful activities or to infringe upon the rights of others.
- The Provider reserves the right to suspend or remove content violating EU law or the Acceptable Use Policy.
- In cases of serious breach, services may be terminated without prior notice.
- Service Availability and Maintenance
- Reasonable efforts are made to ensure high availability; short maintenance windows may occur.
- Notice of planned maintenance will be published on the Provider’s website whenever possible.
- Liability
- The Provider shall be liable for damages caused by willful misconduct or gross negligence.
- For minor negligence, liability is limited to the amount paid by the Client during the preceding 12 months.
- Nothing in this Agreement limits liability for death or personal injury caused by negligence.
- Consumer Rights
- Nothing in this Agreement shall exclude or limit rights granted to consumers under mandatory EU law.
- In case of conflict, mandatory EU consumer protection provisions prevail.
- Termination
- Either party may terminate the Agreement by written notice in accordance with these Terms.
- Termination does not affect obligations accrued prior to termination.
- Governing Law and Jurisdiction
- This Agreement shall be governed by the laws of the European Union and the Republic of Latvia.
- Consumers may bring actions in the courts of their country of residence within the EU, per Regulation (EU) No 1215/2012.
- Amendments
- The Provider may update these Terms to comply with legal or operational requirements, giving at least 14 days’ prior notice.
- Continued use of the Services after the update constitutes acceptance of the new Terms.
- Miscellaneous
- If any provision is found invalid, the remaining provisions shall remain in full force and effect.
- This Agreement constitutes the entire understanding between the parties.
